Host Agreement

This Host Agreement (the “Agreement”) is the agreement between Marvy & Mateo Inversiones, S.R.L. (RNC 1-32-93187-4), a Dominican company that operates exploras.do under the trade name Exploras (“Exploras”, “we”), and each business that offers tours, transport, services or events on Exploras (the “Host”, “you”).

The Agreement completes the Terms of Service, in particular their section 7, and the Privacy Policy. If anything in this Agreement contradicts the Terms, this Agreement prevails for the Host.

1. Electronic acceptance

  • You accept this Agreement by ticking the “I have read and accept” box in your host panel. That acceptance has the same value as a signature under Law 126-02 on Electronic Commerce, Documents and Digital Signatures.
  • As evidence we keep the account that accepted, the business, the version accepted, the date and time, the IP address and the browser. You can ask us for a copy at any time.
  • Whoever accepts declares that they have authority to bind the business.

2. Language

This Agreement is published in Spanish, English and French. For the relationship between Exploras and the Host, the Spanish version of this Agreement and of the Terms of Service is the binding one, even where the Terms say otherwise. The other versions are courtesy translations.

3. What Exploras does, and what it does not

Exploras is a directory: it publishes your business so that travellers can find it and write to you directly. Exploras does not sell your services, does not collect the price of your services, is not a travel agency or tour operator and is not a party to the contract between you and the traveller.

You provide the service in your own name and under your own responsibility (section 7.7 of the Terms), set your own prices and conditions and answer to the traveller and to the authorities.

4. Licences, permits and insurance

Every Host warrants that it holds, and keeps current, the licences, permits, registrations and insurance that the law requires for what it offers (section 7.2 of the Terms).

If you offer boat or catamaran trips, whale watching, fishing, water sports or any other activity at sea, or passenger transport or vehicle rental, you must also upload in the “Documents” tab of your panel:

  • the current licence or permit that authorises the activity (for example the Ministry of Tourism licence or the vessel’s navigation permit; for transport, the driving or operating licence and the vehicle registration);
  • a current insurance policy covering civil liability towards passengers and third parties (for transport, the vehicle insurance).

You must upload the new document before the old one expires. While a document is missing or expired, you cannot buy paid services from Exploras, and we may hide the listings concerned until it is put right. If an authority suspends a licence or your insurance is cancelled, you must tell us at once.

Reviewing a document does not mean that Exploras certifies, guarantees or insures your activity. We do not publish your documents or tell travellers that you are insured. We keep them privately, only to check this point, while you are listed and for up to 24 months afterwards.

5. Travellers’ data

The details a traveller gives you when writing to you (name, phone, dates, group size) you receive as an independent controller under Law 172-13. You may use them only to answer that enquiry and provide the service requested. You may not sell them, pass them on or use them for advertising without the traveller’s consent, and you must protect them and delete them once you no longer need them.

6. Changes

When we change this Agreement we will publish a new, dated version and ask you to accept it the next time you open your panel. If the change materially reduces your rights, we will give you at least 30 days’ notice (section 15 of the Terms). If you do not accept a new version, you may ask us to remove your listing.

7. Duration and termination

This Agreement lasts for as long as your business is listed on Exploras. Either party may end it at any time, as section 13 of the Terms provides. The obligations in sections 4 and 5 concerning events before termination continue afterwards.

8. Governing law and contact

This Agreement is governed by the laws of the Dominican Republic. Disputes are resolved as section 16 of the Terms provides.
